Experience Centre Booking Terms & Conditions
These Terms and Conditions ("Terms") govern the booking and use of the Atelier experience/demonstration premises located at [●address] (the "Premises") by [ATELIER FULL LEGAL / CORPORATE NAME] ("Owner", "Atelier") and any person or entity who books a time slot at the Premises ("Booker/Customer"). Owner and Booker/Customer are together the "Parties".
A booking confirmed under these Terms constitutes a revocable licence to use the Premises for the booked time slot for the purposes stated herein, and does not create any tenancy, lease, or other interest in immovable property in favour of the Booker/Customer, within the meaning of Section 52 of the Indian Easements Act, 1882.
By confirming a booking (whether online, telephonically, or in person) and/or making payment, the Booker/Customer agrees to be bound by these Terms. The Premises is used exclusively for demonstration of the Atelier home-brewing appliance and is not made available for private events or third-party functions.
1. "Booking"
means a confirmed reservation of a time slot at the Premises.
2. "Equipment"
means the Atelier home-brewing appliance(s) and any other electrical or audio-visual equipment and more… made available at the Premises for use during a Booking.
3. "Promotional Segment"
means the period, not exceeding 25 minutes within the allotted time slot, during which Owner may present information about its brands, products, or business, as further described below.
4. "Time Slot"
means the specific date and duration allotted to the Booker/Customer as confirmed in the Booking.

A Booking is confirmed only upon Owner's written or electronic acknowledgment and, where applicable, receipt of the booking amount/deposit. Owner may decline any booking request at its discretion, including where capacity, safety, or scheduling constraints so require.

The number of persons accompanying the Booker/Customer shall not exceed the capacity communicated at the time of Booking. Owner reserves the right to refuse entry to persons in excess of this number.
7. Demonstration Charge and GST.
The Booker/Customer shall pay Owner the demonstration charge specified at the time of Booking (the "Demonstration Charge"), payable in advance in full, or in such instalments as may be agreed at the time of Booking. Goods and Services Tax (GST) at the rate of 18%, or such other rate as may be prescribed under the Central Goods and Services Tax Act, 2017 and the rules made thereunder from time to time, shall be charged in addition to the Demonstration Charge and shall be borne by the Booker/Customer.

Payment shall be made through the modes specified by Owner at the time of Booking, including online payment gateways regulated by the Reserve Bank of India under its Payment Aggregators and Payment Gateways framework. Owner shall issue a tax invoice in respect of the Demonstration Charge and applicable GST in accordance with Section 31 of the Central Goods and Services Tax Act, 2017. A Booking shall not be treated as confirmed until the Demonstration Charge (or the agreed advance instalment thereof) and applicable GST have been received in full.
9. Promotional Segment — pre-booking disclosure.
The Booker/Customer acknowledges and agrees that the allotted Time Slot includes a Promotional Segment of up to 25 minutes, during which Owner will present information about its brands, products, or business. This is disclosed prominently at the point of Booking (prior to payment) and forms part of the consideration for the Time Slot; it is not an additional or hidden obligation.

The Promotional Segment shall be conducted within, and not in extension of, the allotted Time Slot, save with the Booker/Customer's consent.
11. Use of Equipment.
The Booker/Customer agrees to use the Equipment strictly in accordance with Owner's instructions and its regular course of intended usage, and only under the supervision or guidance of Owner's authorised personnel where such supervision is offered.

The Booker/Customer shall not use the Equipment for any purpose other than its intended demonstration/preparation use, and in particular shall not use the home-brewing appliance for the fermentation, distillation, brewing, or production of any alcoholic or intoxicating beverage. Any such use is undertaken entirely at the Booker/Customer's own risk and legal responsibility, and Owner bears no liability whatsoever in connection with it.
13.
Owner shall maintain the Equipment and the electrical installations at the Premises in good working order and in compliance with applicable safety standards and the Electricity Act, 2003 and rules made thereunder.
14. Liability for accidents and incidents.
Save as provided in the following paragraph, Owner shall not be liable for any loss, damage, or harm to the Booker/Customer or their property arising from an electrical or fire-related incident, or a food-related issue, at the Premises, where such loss, damage, or harm is not caused by the negligence, act, or omission of Owner or its personnel.

Nothing in these Terms excludes or limits Owner's liability for death or personal injury caused by the negligence of Owner or its personnel, for gross negligence or wilful default, or for any liability that cannot lawfully be excluded or limited under Applicable Law, including the Consumer Protection Act, 2019 and the Indian Contract Act, 1872.
16.
Owner shall maintain adequate public liability insurance in respect of the Premises and its operations.
17. Food and beverage safety.
Beverages prepared and served at the Premises shall comply with applicable food safety standards under the Food Safety and Standards Act, 2006 and regulations made thereunder. The Booker/Customer shall promptly inform Owner's personnel of any known allergies or dietary restrictions before consuming any beverage prepared at the Premises. It shall be Booker who at his/her will consume beverage/food and Owner shall not be responsible for any liability on health.
18. Cancellation by Owner.
Owner may cancel a confirmed Booking up to two hours prior to the Time Slot due to unavailability of electricity, personnel, or other unforeseen circumstances. In such event, Owner shall, at the Booker/Customer's option, offer an alternative Time Slot or process a full refund of amounts paid (including GST) within 48 hours of cancellation.
19. Cancellation by Booker/Customer.
The Booker/Customer may cancel or reschedule a Booking by written notice to Owner at least [24] hours prior to the Time Slot, subject to the refund/rescheduling policy displayed at the time of Booking.
20. Removal from Premises.
Owner may require a Booker/Customer to leave the Premises where their conduct is abusive, disruptive, unsafe, or in breach of the lawful conduct obligations set out below. Where a Booker/Customer is removed under this paragraph through no fault of their own, Owner shall refund a pro-rata amount (including proportionate GST) for the unused portion of the Time Slot; no refund is due where removal follows the Booker/Customer's own breach of these Terms.
21. Display items and artistic disclaimer.
The Premises may include artefacts, sculptures, paintings, or similar decorative items which are displayed for artistic and ambience purposes only, and are not intended by Owner to offend, demean, or cause distress to any person. If a Booker/Customer has a concern regarding any such item, they should raise it with Owner's personnel, who will address it reasonably, including by relocating the Booker/Customer within the Premises where feasible. This paragraph does not affect the Booker/Customer's rights described above in relation to removal from the Premises.
22. Lawful conduct.
The Booker/Customer shall comply with all Applicable Law while at the Premises and shall not engage in any unlawful, anti-social, or morally offensive activity, including any activity that would constitute an offence under the Bharatiya Nyaya Sanhita, 2023, the Narcotic Drugs and Psychotropic Substances Act, 1985, any applicable State excise or prohibition legislation, or public gambling legislation. The Booker/Customer shall be solely responsible and liable for any such activity engaged in by them or their guests.
23. Photography, recording, and confidentiality of the demonstration.
As the Premises is used exclusively for demonstration of the Atelier home-brewing appliance, the Booker/Customer shall not photograph, film, live-stream, or otherwise record any part of the Premises, the Equipment, the demonstration, or any confidential business information disclosed during the Promotional Segment, without Owner's prior written consent, in order to protect Owner's intellectual property and confidential business information. This restriction applies for the entire duration of each Booking.
24.
Booker/Customer agree to keep confidential all commercial, technical, and operational information disclosed in connection with a Booking, and not to disclose the same to any third party without prior written consent of Owner, except where required by Applicable Law.
25. Direct loss compensation.
Where the Booker/Customer breaches these Terms, the Booker/Customer shall be liable to compensate Owner for any direct, foreseeable loss or damage that naturally arises in the usual course of things from such breach, including damage caused to the Premises or Equipment.
26. Privacy and data protection.
Personal data collected at the time of Booking (name, contact details, and, where applicable, payment information) shall be allowed to be promoted for new updates and marketing purpose for other products launched by Atelier/Owner.
27. Force majeure.
Neither Party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by an event beyond the reasonable control of the affected Party, including acts of God, natural disasters, war, riots or civil commotion, epidemics or public health emergencies, government action or change in law, strikes or lockouts (excluding those involving the affected Party's own workforce), or widespread electrical, internet, or utility failures.
28. Jurisdiction.
These Terms shall be governed by the laws of India. Subject to the Booker/Customer's non-waivable rights under the Consumer Protection Act, 2019, both Parties agree to the exclusive jurisdiction of the courts at Vadodara in respect of any dispute arising out of or in connection with these Terms, including as to their legality or validity.
29. Severability.
If any provision of these Terms is determined to be void or unenforceable under Applicable Law, such provision shall be deemed amended or deleted to the extent reasonably necessary to conform to Applicable Law, and the remaining provisions shall continue to be valid and enforceable.
30. Entire agreement and amendment.
These Terms, together with the particulars confirmed at the time of Booking, constitute the entire agreement between the Parties in respect of the Booking. Owner may update these Terms from time to time; the version in force at the time of Booking shall apply to that Booking.
